AN ACT
amending title 32, chapter 32, article 1, Arizona Revised Statutes, by adding section 32-3210; relating to human egg donation

Be it enacted by the Legislature of the State of Arizona:
Section 1. Title 32, chapter 32, article 1, Arizona Revised Statutes, is amended by adding section 32-3210, to read:
32-3210. Human egg donors; informed consent; unprofessional conduct
A. A human oocyte shall not be harvested from a donor without the voluntary and informed consent of the woman from whom the oocyte is to be harvested. Consent to the donation is voluntary and informed only if both of the following are true:
1. On initial contact with a potential donor, a physician verbally informs the woman of both of the following:
(a) The nature and risks involved with the hormone injection procedures that are required to stimulate the woman's ovaries to produce multiple ripened oocytes for harvesting at one time.
(b) The nature of the harvesting procedure and all known risks of the procedure that a reasonable patient would consider material to the decision of whether or not to undergo the procedure.
2. The woman certifies in writing before the donation that the information required to be provided pursuant to paragraph 1 of this subsection has been provided.
B. A physician who violates this section commits an act of unprofessional conduct and is subject to license suspension or revocation pursuant to title 32, chapter 13 or 17.
