amending title 41, chapter 27, article 1, Arizona revised statutes, by adding section 41‑2959; Repealing section 41‑3012.16, Arizona Revised Statutes; relating to the state lottery.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Subject to the requirements of article IV, part 1, section 1, Constitution of Arizona, title 41, chapter 27, article 1, Arizona Revised Statutes, is amended by adding section 41-2959, to read:

START_STATUTE41-2959.  Arizona state lottery commission; exemption; modified audit

A.  The Arizona state lottery commission is exempt from the termination provisions of this chapter.

B.  Beginning July 1, 2011, at least every ten years the joint legislative audit committee shall conduct a review of the Arizona state lottery commission using the factors that are deemed necessary and that are listed in section 41‑2954, subsection D. END_STATUTE

Sec. 2.  Repeal

Subject to the requirements of article IV, part 1, section 1, Constitution of Arizona, section 41-3012.16, Arizona Revised Statutes, is repealed.

Sec. 3.  Purpose

Pursuant to section 41‑2955, subsection B, Arizona Revised Statutes, the Arizona state lottery commission is continued to oversee a state lottery to produce the maximum amount of net revenue for the state consonant with the dignity of the state.

Sec. 4.  Requirements for enactment; three-fourths vote

Pursuant to article IV, part 1, section 1, Constitution of Arizona, this act is effective only on the affirmative vote of at least three‑fourths of the members of each house of the legislature.
