AN ACT
Amending title 36, Arizona Revised Statutes, by adding chapter 38; relating to health care freedom of choice.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Title 36, Arizona Revised Statutes, is amended by adding chapter 38, to read:
CHAPTER 38
HEALTH CARE FREEDOM OF CHOICE
ARTICLE 1. GENERAL PROVISIONS
36-3801. Health care options; freedom of choice
A. If federal law mandates that all citizens purchase or secure health insurance coverage through a range of options that includes a public plan underwritten in whole or in part by the federal government and the federal law gives each state the right to decline the public plan option, this state shall exercise that right and shall not offer the public plan option.
B. This state shall not enact any law to compel, directly or indirectly, any person, employer or health care provider to participate in any health care system.
C. A person or employer may pay directly for lawful health care services and shall not be penalized in any manner for paying directly for lawful health care services.
D. A health care provider may accept direct payment for lawful health care services and shall not be penalized in any manner for accepting direct payment from a person or employer for lawful health care services.
E. Subject to reasonable and necessary rules that do not substantially limit a person's options, this state shall not prohibit the purchase or sale of health insurance in private health care systems.
