AN ACT

 

Amending title 44, CHAPTER 1, ARTICLE 3, Arizona Revised Statutes, by adding section 44-135; relating to CAPACITY to contract.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 44, chapter 1, article 3, Arizona Revised Statutes, is amended by adding section 44-135, to read:

START_STATUTE44-135.  Capacity of a minor who is a parent to consent to medical treatment

A.  Notwithstanding any other law, a minor who is at least sixteen years of age, who is also a parent and who is otherwise competent may consent to medical treatment and the consent of the minor's parent or legal guardian is not necessary to authorize hospital or medical care.

B.  Consent given pursuant to this section is not subject to disaffirmance because of the person's minority. END_STATUTE
