AN ACT
Amending title 36, chapter 4, article 1, Arizona Revised Statutes, by adding section 36-415; relating to health care institutions.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Title 36, chapter 4, article 1, Arizona Revised Statutes, is amended by adding section 36-415, to read:
36-415. Hospitals; emergency rooms; medicare reimbursement; limitation
A health care services plan as defined in section 20-2801 shall pay a hospital not more than one hundred ten per cent of medicare allowed charges for emergency room services as determined by the director of the United States department of health services if all of the following apply:
1. The hospital is a noncontracted health provider.
2. The hospital has fewer than thirty beds.
3. The hospital is located in a county with a population of more than one million persons.
4. The hospital is located within ten miles of an acute care hospital that provides emergency room services.
