AN ACT

 

amending title 41, chapter 1, article 2, Arizona Revised Statutes, by adding section 41-134; relating to the secretary of state.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 41, chapter 1, article 2, Arizona Revised Statutes, is amended by adding section 41-134, to read:

START_STATUTE41-134.  Safe at home program; program termination

A.  On or before December 31, 2012, the secretary of state shall establish the safe at home program to allow persons who have been subjected to domestic violence offenses, sexual offenses or stalking or harassment offenses to keep their residence addresses confidential and not accessible to the general public.  Participants in the program shall receive a substitute address that becomes the participant's lawful address of record, and the secretary of state shall establish a method for forwarding to the participants their first class mail.

B.  The program established pursuant to this section ends on July 1, 2021 pursuant to section 41-3102. END_STATUTE

Sec. 2.  Funding intent

It is the intent of the legislature that the safe at home program established pursuant to section 41-134, Arizona Revised Statutes, as added by this act, shall not be funded by the state general fund but shall be funded by levying a surcharge on fines or other penalties assessed against persons who are convicted of offenses involving domestic violence, sexual offenses and offenses involving violations of injunctions against harassment.
