AN ACT

 

amending title 41, chapter 12, article 2, Arizona Revised Statutes, by adding section 41-1725; relating to the department of public safety.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 41, chapter 12, article 2, Arizona Revised Statutes, is amended by adding section 41-1725, to read:

START_STATUTE41-1725.  Significant psychological episode or incident reporting; database

A.  A public agency, including an educational institution, that has information that a person has suffered a significant or severe psychological episode or incident and that has documented the episode or incident shall report the person's name, date of birth and social security number to the department.

B.  The department shall maintain a computerized record system that contains the information received pursuant to subsection A.  The record system shall be accessible to criminal justice agencies for the purpose of investigating and enforcing the laws of this state and the United States.  This information shall not be available to any other person or entity except on an order from a state or federal court.

C.  The department shall adopt rules for the purpose of implementing and carrying out the provisions of this section. END_STATUTE
