AN ACT

 

amending title 41, chapter 7, article 3, Arizona Revised Statutes, by adding section 41-1134; relating to the legislature.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 41, chapter 7, article 3, Arizona Revised Statutes, is amended by adding section 41-1134, to read:

START_STATUTE41-1134.  Special hearings; escape involving private prisons

A.  The senate judiciary committee and the house of representatives judiciary committee, or their successor committees, shall hold a joint hearing within seven days after a prisoner escapes from a private prison in this state or a facility that is operated by a private contractor that contracts with any government entity to provide detention or incarceration services for offenders in this state.  At the joint hearing, the following persons shall testify and answer questions about the escape:

1.  The governor or the governor's designee.

2.  The director of the state department of corrections.

3.  The director of the department of public safety.

4.  A representative of the private prison or the private contractor that operates the facility where the escape occurred.

B.  If the legislature is not in session at the time the escape occurs, the president of the senate and the speaker of the house of representatives shall call a meeting of their respective judiciary committees, or their successor committees, to comply with subsection A.END_STATUTE
