AN ACT

 

establishing The joint legislative study committee on outcome-based education funding.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Joint legislative study committee on outcome‑based education funding; membership; duties; report; delayed repeal

A.  The joint legislative study committee on outcome‑based education funding is established consisting of the following members:

1.  Two members of the senate, neither of whom are members of the same political party, who are appointed by the president of the senate.

2.  Two members of the house of representatives, neither of whom are members of the same political party, who are appointed by the speaker of the house of representatives.

3.  The executive director of the state board of education or the executive director's designee.

4.  An employee of the department of education who is appointed by the superintendent of public instruction.

5.  A representative from a statewide organization of school business officials who is appointed by the president of the senate.

6.  A representative from a statewide organization of school district governing board members who is appointed by the speaker of the house of representatives.

7.  A representative from a statewide organization of school superintendents who is appointed by the president of the senate.

8.  A representative from a statewide organization of business and education persons who is appointed by the speaker of the house of representatives.

9.  A certificated teacher who currently provides classroom instruction in kindergarten or grades one through five, and who is a member of a statewide organization representing teachers and school district employees, who is appointed by the speaker of the house of representatives.

10.  A certificated teacher who currently provides classroom instruction in grades six through eight who is appointed by the president of the senate.

11.  A certificated teacher who currently provides classroom instruction in grades nine through twelve who is appointed by the speaker of the house of representatives.

B.  The committee shall:

1.  Develop legislation for consideration during the fiftieth legislature, second regular session, that will transition public school funding from a system based on instructional hours to a system based on student achievement and that includes consideration of:

(a)  The interaction of current voter‑approved revenue sources and spending requirements with the new proposed system of public school funding.

(b)  The entities that will be responsible for the determination of appropriate student outcomes on which the new proposed system of public school funding will be based.

2.  Submit a report regarding the committee's activities and recommendations for legislative action on or before December 31, 2011 to the governor, the president of the senate and the speaker of the house of representatives and provide a copy of this report to the secretary of state.

C.  This section is repealed from and after September 30, 2012.

Sec. 2.  Emergency

This act is an emergency measure that is necessary to preserve the public peace, health or safety and is operative immediately as provided by law.
