A CONCURRENT RESOLUTION

 

enacting and ordering the submission to the people of a measure relating to unfunded mandates on cities, towns and counties.

Be it resolved by the House of Representatives of the State of Arizona, the Senate concurring:

1.  Under the power of the referendum, as vested in the legislature, the following measure, relating to unfunded mandates on cities, towns and counties, is enacted to become valid as a law if approved by the voters and on proclamation of the Governor:

AN ACT

amending title 1, chapter 2, article 3, Arizona Revised Statutes, by adding section 1‑255; relating to unfunded mandates on cities, towns and counties.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 1, chapter 2, article 3, Arizona Revised Statutes, is amended by adding section 1-255, to read:

START_STATUTE1-255.  Legislation imposing unfunded mandates on cities, towns or counties; effect

A statute enacted by the legislature that requires any city, town or county to engage in any new activity, provide a new service, increase any current level of activity or provide any service beyond that required by existing statute does not have the force of law unless the legislature provides the city, town or county with new funding or a means of new funding in an amount that is sufficient to pay the cost of performing the mandated activity or service for the period of time during which the activity or service is required to be performed. 2.  The Secretary of State shall submit this proposition to the voters at the next general election as provided by article IV, part 1, section 1, Constitution of Arizona.
