A CONCURRENT RESOLUTION

 

proposing an AMENDMENT to the Constitution of Arizona; AMENDING article Vii, section 10, Constitution of Arizona; relating to primary elections.

Be it resolved by the House of Representatives of the State of Arizona, the Senate concurring:

1.  Article VII, section 10, Constitution of Arizona, is proposed to be amended as follows if approved by the voters and on proclamation of the Governor:

START_STATUTE10.  Direct primary election law

Section 10.  A.  The legislature shall enact a direct primary election law, which shall provide for the nomination of candidates for all elective state, county, and city offices, including candidates for United States senator and for representative in Congress.

B.  Except for elections for members of the Arizona house of representatives and Arizona senate, any person who is registered as no party preference or independent as the party preference or who is registered with a political party that is not qualified for representation on the ballot may vote in the primary election of any one of the political parties that is qualified for the ballot.

C.  For elections for members of the Arizona house of representatives and Arizona senate only, the following apply:

1.  Any person who is registered to vote is eligible to vote for any candidate who appears on a primary election ballot, without regard to that candidate's political party affiliation, if any.

2.  All candidates in the primary election shall be listed on the same ballot.

3.  A candidate may choose to declare a political party affiliation, and if the candidate so chooses, the candidate's choice of party affiliation shall appear with the candidate's name on any ballot. If the candidate chooses not to declare a political party affiliation, the words "no party preference" shall appear with the candidate's name on any ballot.

4.  For candidates for the same seat in the Arizona senate, the two candidates who receive the highest number of votes for that office shall advance to the general election.

5.  For candidates for the two seats in the Arizona house of representatives that represent the same district, the four persons who receive the highest number of votes for those seats shall advance to the general election for those two seats. END_STATUTE

2.  The Secretary of State shall submit this proposition to the voters at the next general election as provided by article XXI, Constitution of Arizona.
