AN ACT

 

amending title 28, chapter 3, article 15, Arizona Revised Statutes, by adding section 28‑913; relating to use of handheld wireless communication devices while driving.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 28, chapter 3, article 15, Arizona Revised Statutes, is amended by adding section 28-913, to read:

START_STATUTE28-913.  Handheld wireless communication device use while driving; prohibition; civil penalties

A.  A person may not use a handheld wireless communication device while operating a motor vehicle.

B.  Except as provided in subsection C, a person who is found responsible for a violation of this section is subject to the following:

1.  For a first offense, a civil penalty of one hundred dollars.

2.  For a second offense, a civil penalty of two hundred fifty dollars plus community service as determined by the court.

3.  For a third or subsequent offense, a civil penalty of five hundred dollars plus community service as determined by the court.

C.  If a person violates this section, the person is involved in a motor vehicle accident and it is determined that the violation of this section is the cause of the accident, the civil penalty is two times the amount prescribed in subsection B. END_STATUTE
