AN ACT
amending title 36, chapter 7.1, Arizona Revised Statutes, by adding article 2; relating to administrative review of child care programs.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Title 36, chapter 7.1, Arizona Revised Statutes, is amended by adding article 2, to read:
ARTICLE 2. ADMINISTRATIVE REVIEWS
36-894. Department reviews; posting requirements; advisory committee
A. On or before December 31 of each odd-numbered year, the department shall complete and make available to the public a review of its costs to administer articles 1 and 4 of this chapter during the previous two years. The department must complete its first review on or before December 31, 2011. The department shall make the review available to the public by posting the review on its website. The review shall:
1. Build on the most recent cost study and any prior reviews.
2. Report on the progress of implementing the recommendations contained in the most recent cost study.
3. Identify the total amount of fees collected, operating costs and issues affecting the collection of fees.
4. Describe how the department uses available resources to administer licensing requirements in the most efficient manner possible and with respect to timeliness, accuracy and quality of service.
5. Analyze the fee category groups to determine if the groups reflect an equitable distribution of fees.
6. Determine the amount and potential impact of fees based on the amount of time and costs required to license child care facilities and certify child care group homes. The department shall determine the amount and impact of fees for child care facilities and child care group homes separately.
7. Identify costs associated with investigations and enforcement of unlicensed child care facilities and uncertified child care group homes and determine the fees if these costs and other shared costs are allocated to licensed facilities and certified group homes proportionally.
8. Develop recommendations for inspecting facilities on a risk assessment basis without jeopardizing the health and safety of children.
9. Develop a plan for and report on a transition from three year fees to annual fees.
B. The department shall convene an advisory committee at least three times to examine the scope of the review, interim findings and preliminary results of the review. The advisory committee shall include representatives of licensed child care facilities, certified child care group homes and child care associations in this state.
