AN ACT
repealing title 36, chapter 29, Arizona Revised Statutes; repealing section 41-3013.01, Arizona Revised Statutes; relating to the Arizona health care cost containment system.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Delayed repeal
Title 36, chapter 29, Arizona Revised Statutes, is repealed from and after September 30, 2011.
Sec. 2. Repeal
Section 41-3013.01, Arizona Revised Statutes, is repealed.
Sec. 3. Department of health services; health care services for the indigent
Subject to the availability of appropriated monies, beginning October 1, 2011, the department of health services shall implement a program to provide services to medically indigent individuals in this state. The program shall provide medical services as prescribed by the department by rule. The program shall also provide services to developmentally disabled individuals and individuals receiving behavioral health services pursuant to title 36, chapter 29, Arizona Revised Statutes, as repealed by this act. The rules shall provide for a system of reinsurance that is modeled after reinsurance prescribed by the Arizona health care cost containment system administration. The rules shall also require the program to use the private sector to deliver the services.
Sec. 4. Distribution of savings; legislative intent
It is the intent of the legislature that the savings realized through the termination of the Arizona health care cost containment system shall be distributed as follows in addition to other appropriations:
1. $200,000,000 to the department of health services for behavioral health services.
2. $200,000,000 to the department of health services for services to developmentally disabled individuals.
3. $500,000,000 to the department of health services to provide medical services to indigent individuals as prescribed in this act.
4. $900,000,000 to the state general fund.
Sec. 5. Exemption from rule making
For the purposes of this act, the department of health services is exempt from the rule making provisions of title 41, chapter 6, Arizona Revised Statutes, for two years after the effective date of this act.
Sec. 6. Conforming legislation
The legislative council staff shall prepare proposed legislation conforming the Arizona Revised Statutes to the provisions of this act for consideration in the fiftieth legislature, second regular session.
Sec. 7. Emergency
This act is an emergency measure that is necessary to preserve the public peace, health or safety and is operative immediately as provided by law.
