AN ACT
Amending title 30, Arizona Revised Statutes, by adding chapter 2; relating to nuclear fuel recycling.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Title 30, Arizona Revised Statutes, is amended by adding chapter 2, to read:
CHAPTER 2
NUCLEAR FUEL RECYCLING
ARTICLE 1. GENERAL PROVISIONS
30-301. Nuclear fuel recycling; facility fees; nuclear recycling public school fund
A. If a nuclear fuel recycling facility is established in this state, the following apply:
1. The federal government shall pay for the development of the nuclear fuel recycling facility.
2. The operation of the nuclear fuel recycling facility shall be a joint venture between the federal government, this state and a private entity.
3. This state shall charge the federal government a negotiated fee per unit of fuel for the right to develop this facility. All fees collected shall be deposited in the nuclear recycling public school fund established by this section.
B. The nuclear recycling public school fund is established for the support and maintenance of public schools, including kindergarten programs, grades one through twelve, community colleges and universities. The state treasurer shall administer the fund. The fund shall consist of monies collected pursuant to subsection A. Monies in the fund are subject to legislative appropriation. Monies in the fund are intended to offset state general fund expenditures for public education.
