AN ACT
amending title 13, chapter 29, Arizona Revised Statutes, by adding section 13-2931; relating to offenses against public order.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Title 13, chapter 29, Arizona Revised Statutes, is amended by adding section 13-2931, to read:
13-2931. Unlawful possession of graffiti implements; minors; exception; classification; definition
A. It is unlawful for a person who is under eighteen years of age to possess any graffiti implement while on public or private property without the express consent of the owner of the property.
B. This section does not apply to a minor who either:
1. Is under the immediate supervision of a parent or legal guardian.
2. Possesses written permission from the minor's parent or legal guardian to possess the graffiti implement for a specific purpose.
3. Possesses the graffiti implement in the course of lawful employment or for the purpose of taking the graffiti implement to or from the minor's school.
C. A person who violates this section is guilty of a petty offense.
D. For the purposes of this section, "graffiti implement" includes aerosol or pressurized paint containers and etching tools or solutions.
