AN ACT

 

providing for the retroactive application of laws relating to driving under the influence.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Application

A.  Laws 2011, chapter 341, applies retroactively to any person who is sentenced from and after April 29, 2011 for a violation of section 28‑1381, 28-1382 or 28-1383, Arizona Revised Statutes, regardless of the date of the offense.

B.  Subsection A of this section does not apply to any of the following:

1.  Section 28-1321, Arizona Revised Statutes, as amended by Laws 2011, chapter 341, section 8.

2.  Section 28-1381, subsection F, Arizona Revised Statutes, as amended by Laws 2011, chapter 341, section 9.

3.  Section 28-1383, Arizona Revised Statutes, as amended by Laws 2011, chapter 341, section 11.

4.  Section 28-1385, Arizona Revised Statutes, as amended by Laws 2011, chapter 341, section 12.

5.  Section 28-1461, Arizona Revised Statutes, as amended by Laws 2011, chapter 341, section 15.

6.  Section 28-1464, Arizona Revised Statutes, as amended by Laws 2011, chapter 341, section 16.

7.  Section 28-2163, Arizona Revised Statutes, as amended by Laws 2011, chapter 341, section 19.
