AN ACT

 

Amending title 25, chapter 2, article 2, Arizona Revised Statutes, by adding section 25‑219; relating to surrogate parentage contracts.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 25, chapter 2, article 2, Arizona Revised Statutes, is amended by adding section 25-219, to read:

START_STATUTE25-219.  Surrogate parent; health insurance; definition

A.  A mother or father who enter into a surrogate parentage contract must procure private health insurance coverage for the surrogate mother to cover the course of the pregnancy, the delivery and any care up to six weeks after the delivery that is related to the delivery.

B.  For the purposes of this section, "surrogate parentage contract" means a contract, agreement or arrangement in which a woman agrees to the implantation of an embryo not related to that woman or agrees to conceive a child through natural or artificial insemination and to voluntarily relinquish her parental rights to the child. Sec. 2.  Applicability

Section 25‑219, Arizona Revised Statutes, as added by this act, applies to surrogate parentage contracts entered into from and after the effective date of this act.
