AN ACT

 

amending title 41, chapter 16, article 3.1, Arizona Revised Statutes, by adding section 41‑2170.09; amending title 42, chapter 3, article 5, Arizona Revised Statutes, by adding section 42‑3204; amending title 44, chapter 27, article 2, Arizona Revised Statutes, by adding section 44‑7112; relating to cigarette manufacturers.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 41, chapter 16, article 3.1, Arizona Revised Statutes, is amended by adding section 41-2170.09, to read:

START_STATUTE41-2170.09.  Manufacturer of cigarettes; cigarettes sold to a consumer

Every person who maintains a machine at a retail establishment that enables any person to process at that establishment tobacco or any product that is made or derived from tobacco into a roll or tube is a manufacturer of cigarettes and the resulting product is cigarettes sold to a consumer for purposes of this article. END_STATUTE

Sec. 2.  Title 42, chapter 3, article 5, Arizona Revised Statutes, is amended by adding section 42-3213, to read:

START_STATUTE42-3213.  Cigarette manufacturer; cigarettes sold to a consumer

Every person who maintains a machine at a retail establishment that enables any person to process at that establishment tobacco or any product that is made or derived from tobacco into a roll or tube is a cigarette manufacturer and the resulting product is cigarettes sold to a consumer for purposes of this article. Sec. 3.  Title 44, chapter 27, article 2, Arizona Revised Statutes, is amended by adding section 44-7112, to read:

START_STATUTE44-7112.  Manufacturer of cigarettes; cigarettes sold to a consumer

Every person who maintains a machine at a retail establishment that enables any person to process at that establishment tobacco or any product that is made or derived from tobacco into a roll or tube is a manufacturer of cigarettes and the resulting product is cigarettes sold to a consumer for purposes of this chapter.
