AN ACT

 

amending title 44, chapter 11, article 6, Arizona Revised Statutes, by adding section 44‑1698.02; relating to consumer reporting agencies.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 44, chapter 11, article 6, Arizona Revised Statutes, is amended by adding section 44-1698.02, to read:

START_STATUTE44-1698.02.  Notification to consumer before sale of personal information; definition

A.  A consumer reporting agency must notify a consumer residing in this state in writing before selling the consumer's personal information.  The written notification shall include all of the following:

1.  The name, principal place of business and website address of the consumer reporting agency.

2.  A concise description of how the consumer reporting agency obtains personal information.

3.  A concise description of the types of entities to whom the consumer reporting agency sells the consumer's personal information and whether the consumer reporting agency prohibits the entities from further disclosing the personal information.

4.  Whether the consumer reporting agency allows a consumer to opt out of further sale of the consumer's personal information.

B.  For the purposes of this section, "consumer reporting agency" means any entity that does both of the following:

1.  For monetary fees, dues or on a cooperative nonprofit basis, regularly engages in whole or in part in the practice of assembling or evaluating consumer credit information or other information on consumers for the purpose of furnishing consumer reports to third parties.

2.  Uses any means or facility of interstate commerce for the purpose of preparing or furnishing consumer reports. END_STATUTE
