AN ACT

 

amending title 9, chapter 4, article 8, Arizona Revised Statutes, by adding section 9‑499.16; relating to cities and towns.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 9, chapter 4, article 8, Arizona Revised Statutes, is amended by adding section 9-499.16, to read:

START_STATUTE9-499.16.  Alarm system installation; licensed contractors; state preemption

A.  The regulation and licensing of alarm system installation companies are of statewide concern.  Obtaining information and licensing of alarm system installation companies is not subject to further regulation by a city, town or other political subdivision of this state.

B.  A city or town may not require a person who is licensed as an electrical contractor pursuant to title 32, chapter 10 to be additionally licensed or registered pursuant to a city or town ordinance in order for the person to install an alarm system.

C.  Without a court order, a city or town may not request or obtain personal customer information from any business as a condition of doing business in the city or town.

D.  If a city or town violates this section, the state treasurer shall withhold from the distribution of state shared revenues to the affected city or town five per cent of the amount of the state shared revenues for each violation until the city or town corrects the violation. END_STATUTE
