AN ACT

 

amending Laws 2010, chapter 247, section 3; relating to the department of education.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Laws 2010, chapter 247, section 3 is amended to read:

Sec. 3.  Existing school achievement profiles; phase-out

Notwithstanding sections 15‑241 and 15‑241.01, Arizona Revised Statutes, as amended by this act, for the remainder of the academic year in which the effective date of this act occurs and the next academic year after the effective date of this act, each school district and charter school shall be designated both of the following:

1.  An achievement profile that corresponds to the classification that the school would have otherwise been designated under the laws that were in effect immediately before the effective date of this act.

2.  An achievement profile that corresponds to the grade letter assigned to that school under the laws that are in effect on the effective date of this act.

Sec. 2.  School achievement profiles; school improvement; failing schools

Notwithstanding section 15-241, subsection O, Arizona Revised Statutes, each school, school district and charter school that is assigned a letter grade of D shall be assigned a letter grade of F if the school has been required to participate in the mandatory school improvement process pursuant to section 15-241, subsection K, Arizona Revised Statutes, for the prior two consecutive academic years.  In academic year 2012-2013, a school, school district or charter school may be assigned a letter grade of F if the school's classification under the version of section 15-241, Arizona Revised Statutes, in effect before September 1, 2011 was underperforming. In academic year 2013-2014, a school may be assigned a letter grade of F if the school was assigned a letter grade of D in academic year 2012-2013, and the school's classification in academic year 2011-2012 under the version of section 15‑241, Arizona Revised Statutes, in effect before September 1, 2011 was underperforming.

Sec. 3.  Delayed repeal

Section 2 of this act, relating to school improvement profiles, school improvement and failing schools, is repealed from and after June 30, 2014.
