FLOOR AMENDMENT EXPLANATION

 

 

Modifies the definition of qualifying party by removing political subdivisions and adding school districts.

 

Removes proposed language that would have allowed for a political subdivision to enter into an intergovernmental agreement with another political subdivision for the purpose of obtaining the services of the other political subdivision’s qualifying party. 

 

Requires a political subdivision that uses pesticides to conduct pest management on property it owns, leases or manages to provide the Arizona Department of Agriculture with a contact person(s) responsible for responding to inquires or concerns regarding compliance and stipulates minimum record keeping requirements.

 

Requires a school district to have a qualifying party registered in the appropriate categories rather than requiring a contact person.

 

Makes technical and conforming changes.

"2.  Must provide the department with the name and telephone number of

the primary contact person or persons responsible for responding to department inquiries or concerns regarding compliance with this chapter.  The primary contact person or persons at a minimum shall demonstrate to the Department:

(a)  Where the records are retained.

(b)  Where the personal protective equipment is located.

(c)  Where the pesticides are stored.

(d)  That all applicators are properly certified.

B.  A school district is exempt from subsection A, paragraph 2 of this section, but shall have a qualifying party who is registered in the appropriate categories."
