Page 6, line 10, after the semicolon insert "applicability;"

Strike lines 11 through 15; line 16, strike "attorney general" insert:

"A.  Notwithstanding any other law, on or before five years after the effective date of this section, any agency of this state that owns or licenses computerized data that includes personal information of a person who is a resident of this state must encrypt the data in accordance with statewide information technology policies and standards if the data is stored in a database.  If the data is not stored in a database, the encryption standard prescribed by this subsection does not apply but best practices should be implemented to protect the data.

B.  This section does not apply to a legacy database system that was implemented on or before January 1, 2000.

C.  A prosecutor in this state"

Line 17, after the period strike remainder of line; strike lines 18 through 22, insert:

"Sec. 7.  Conditional enactment; notice

A.  Section 44-7503, Arizona Revised Statutes, as added by this act, does not become effective unless the department of administration receives an appropriation for the implementation of the encryption requirements of that section.

B.  The department of administration shall notify in writing the director of the Arizona legislative council of this date."
