Page 3, after line 14, insert:

“Sec. 3.  Joint legislative study committee on assisted reproductive                  technology; membership; duties; report; delayed repeal

A.  The joint legislative study committee on assisted reproductive technology is established consisting of the members of the house of representatives health committee of reference and the senate health and human services committee of reference.

B.  The chairman of the senate health and human services committee shall be the chairperson.

C. The committee shall research and report on the following:

1. The benefits and costs of assisted reproductive technology in this state.

2. The effect of assisted reproductive technology on third parties, including gamete donors, donor-conceived children and human embryos formed through in vitro fertilization.

3. Whether regulation of the practice of assisted reproductive technology in this state is necessary to protect public health and safety or to protect the interests of third parties.

4. If the committee determines that regulation would protect public health and safety or protect the interests of third parties, possible categories of regulation that might be enacted and types of regulation of assisted reproductive technology in other states and countries.

D. The committee may:

1. Request information, data and reports from any state agency or political subdivision of this state or from any private entity involved in the practice of assisted reproductive technology.  If possible, information shall be provided electronically. Information gathered shall be redacted as necessary to protect patient privacy.

2.  Hold hearings, conduct fact-finding tours and take testimony from witnesses, including participants in the field of assisted reproductive technology, who may assist the committee in fulfilling its responsibilities.

E. The committee shall meet at places and times as the chairperson deems necessary or convenient, and all meetings shall be open to the public.

F.  The legislature shall provide staff and support services to the committee.

G. Members of the study committee are not eligible to receive compensation but are eligible for reimbursement of expenses pursuant to title 38, chapter 4, article 2, Arizona Revised Statutes.

H.  On or before January 1, 2014, the study committee shall submit a report regarding its findings and recommendations to the governor, the speaker of the house of representatives and the president of the senate.  

I.  This section is repealed from and after September 30, 2014.

Sec. 4.  Statistical report

The department of health services shall issue the first annual statistical report required by this act upon completion of the first full year of reporting.”
