AN ACT
amending title 13, chapter 8, Arizona Revised Statutes, by adding section 13-814; relating to restitution and fines.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Title 13, chapter 8, Arizona Revised Statutes, is amended by adding section 13-814, to read:
13-814. Community restitution work program credits
A. Notwithstanding any other law, If a community restitution work program is available pursuant to section 9-499.07, the court may order that a person receive credit towards the payment of any fine, penalty, surcharge or assessment in an amount to be determined by the court for participation in a community restitution work program. Before making an order pursuant to this section, the court shall determine in open court that the person does not have the financial resources available to complete payment of the fine, penalty, surcharge or assessment unless the person receives credit for participation in a community restitution work program.
B. The section does not apply to any court ordered victim restitution.
