AN ACT
Amending title 40, chapter 2, article 1, Arizona Revised Statutes, by adding section 40‑211; relating to the corporation commission.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Title 40, chapter 2, article 1, Arizona Revised Statutes, is amended by adding section 40-211, to read:
40-211. Energy efficiency standards; cost-effectiveness; definitions
A. The commission may not require a public service corporation to implement any energy efficiency standard unless the standard is cost‑effective to the ratepayers.
B. The commission may not require a public service corporation to reach a specific energy efficiency standard without first having evaluated whether the specific energy efficiency programs proposed by the public service corporation are cost-effective.
C. For the purposes of this section:
1. "Cost‑effective" means that the total incremental benefits from an energy efficiency measure or energy efficiency program exceed the total incremental costs over a five year period.
2. "Incremental benefits" means the cost of electricity that is directly and actually avoided by the energy efficiency program.
3. "Incremental costs" include all support and operational costs, performance incentives and unrecovered fixed costs to the utility of the energy efficiency program.
