AN ACT

 

amending title 13, chapter 30, Arizona Revised Statutes, by adding section 13-3007; relating to house interim study committee on unmanned aircraft.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 13, chapter 30, Arizona Revised Statutes, is amended by adding section 13-3007, to read:

START_STATUTE13-3007.  House interim study committee on unmanned aircraft; report; delayed repeal

A.  The house interim study committee on unmanned aircraft is established consisting of Three members of the house of representatives who are appointed by the speaker of the house of representatives, not more than two of whom are members of the same political party.  The speaker of the house of representatives shall designate one of these members to serve as chairperson of the committee.

B.  The committee shall study the use of an unmanned aircraft for the following purposes:

1.  to counter a high risk of a terrorist attack by a specific individual or organization if the United States Secretary of Homeland Security determines that credible intelligence indicates that there is such a risk.

2.  if the law enforcement agency first obtains a search warrant signed by a judge authorizing the use of an unmanned aircraft.

3.  If the law enforcement agency possesses reasonable suspicion that, under particular circumstances, swift action is needed to prevent imminent danger to life or serious damage to property, or to forestall the imminent escape of a suspect or the destruction of evidence.

C.  The committee shall also assess the economic development, safety and privacy concerns and potential applications of the use of an unmanned aircraft.

D.  The committee shall submit a report regarding the committee's findings and recommendations on or before December 31, 2013 to the governor, the president of the senate and the speaker of the house of representatives and provide a copy of this report to the secretary of state.

E.  This section is repealed from and after September 30, 2014.
