AN ACT

 

amending title 33, chapter 16, article 1, Arizona Revised Statutes, by adding section 33-1818; relating to planned communities.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 33, chapter 16, article 1, Arizona Revised Statutes, is amended by adding section 33-1818, to read:

START_STATUTE33-1818.  Age-restricted planned communities; master association dues; limitation

A.  Notwithstanding any provision in the community documents and the documents that govern a master association, members of an age-restricted planned community may lawfully be required to make payments to a master association of planned communities only as follows:

1.  The community documents for the planned community or the recorded documents that establish or govern the master association require the planned community or its members to be a member of the master association of planned communities.

2.  The community documents for the planned community or the recorded documents that ESTABLISH or govern the master association require The planned community or its members to pay certain assessments, dues or other payments, however denominated.

3.  The planned community is an age-restricted community that is lawfully established and that is permitted by law to operate as an age‑restricted community.

4.  The members of the age-restricted planned community are not required to pay more than the lesser of the following:

(a)  The master association's cost to provide services to support the members of the age-restricted planned community's use of the common areas of the master association that are not otherwise paid for by the members' payments to the members' planned community.

(b)  Not more than twenty per cent of the master association's regular, special or other assessments, dues and other payments normally charged to the members' planned community.

B.  Solely at the option of the planned community member, a member of an age-restricted planned community may voluntarily make a full payment to the master association. END_STATUTE
