AN ACT

 

amending Title 15, chapter 7, article 4, Arizona Revised Statutes, by adding section 15-768; relating to special education.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 15, chapter 7, article 4, Arizona Revised Statutes, is amended by adding section 15-768, to read:

START_STATUTE15-768.  Contracting and cooperative agreements for special education

A.  The governing board of a school district may contract with any public body or any private person for the purpose of providing special education.  For the purposes of this subsection, school districts are exempt from section 15‑213.

B.  School districts may independently or jointly make application for special education monies.

C.  School districts may provide for joint cooperation among themselves and with each other and with any educational institution eligible to receive special education monies for the purposes of providing special education and for the use of each other's facilities and personnel.

D.  School districts may jointly purchase, sell, lease or lease‑purchase land, buildings or other real or personal property for the purposes of providing special education, if:

1.  The school districts enter into an intergovernmental agreement or other written contract pursuant to section 11‑952.

2.  The state board of education approves the intergovernmental agreement or other written contract.

E.  A school district may individually or jointly accept gifts or grants of monies, land or other real or personal property for the purpose of providing special education and may administer or dispose of the property in accordance with the purpose of the gift or grant.  END_STATUTE
