AN ACT
amending title 41, chapter 3, article 1.1, Arizona Revised Statutes, by adding section 41‑511.17; relating to the ARizona state parks board.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Title 41, chapter 3, article 1.1, Arizona Revised Statutes, is amended by adding section 41-511.17, to read:
41-511.17. Sustainable state parks and roads donation; sustainable state parks and roads fund; subaccounts
A. At the time of vehicle registration, any person who is required to register a motor vehicle in this state pursuant to section 28‑2153 may make, in addition to the registration fee, an annual sustainable state parks and roads donation in an amount to be determined by the Arizona state parks board. This subsection does not apply to the registration of a commercial motor vehicle as defined in section 28‑601. On payment of the sustainable state parks and roads donation, the Arizona state parks board may issue a promotional gift that is determined by the Arizona state parks board, subject to the review of the joint legislative budget committee.
B. The registering officer shall collect the sustainable state parks and roads donations and immediately deposit, pursuant to sections 35‑146 and 35‑147, eighty-five per cent of the donations in the state parks subaccount and fifteen per cent of the donations in the department of transportation subaccount of the sustainable state parks and roads fund established by subsection C of this section. Monies in the sustainable state parks and roads fund may be used only for the purposes of subsection C of this section.
C. The sustainable state parks and roads fund is established consisting of donations deposited pursuant to this section. The Arizona state parks board shall administer the fund. Monies in the fund are continuously appropriated. The director of the Arizona state parks board shall establish a separate department of transportation subaccount and a separate state parks subaccount in the sustainable state parks and roads fund for the deposit of monies received pursuant subsection B of this section. The Arizona state parks board shall use the monies in the state parks subaccount to operate, maintain and make capital improvements to buildings, roads, parking lots, highway entrances and any related structure used to operate state parks. The department of transportation shall use the monies in the department of transportation subaccount to operate, maintain and make capital improvements to highway rest areas and any other transportation related purposes.
