Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 15, chapter 14, article 2, Arizona Revised Statutes, is amended by adding section 15-1826, to read:

START_STATUTE15-1826.  Postsecondary remedial courses; tuition reimbursement; definition

A.  If a student who graduated from a high school in a school district in this state cannot obtain the minimum score on a standardized entrance examination that would enable the student to attend a postsecondary educational institution without enrolling in one or more remedial courses in the student's first academic year of postsecondary instruction, the school district where the student graduated from high school shall reimburse the university or community college district for the cost of tuition for the remedial courses.  The amount of reimbursement shall not exceed the total amount of tuition charged to that student by the university or community college district for remedial courses during the student's first academic year of postsecondary instruction.

B.  A school district shall pay reimbursement charged pursuant to this section from the school district's maintenance and operation section of the budget.

C.  For the purposes of this section, "remedial course" means a course that is offered by a university or community college and that is designed to correct a student's deficiencies in basic mathematics skills, reading skills or writing skills in order to allow the student to perform at a level of competence necessary for postsecondary study.
