A CONCURRENT RESOLUTION

 

enacting and ordering the submission to the people of a measure relating to the arizona health care cost containment system.

Be it resolved by the House of Representatives of the State of Arizona, the Senate concurring:

1.  Under the power of the referendum, as vested in the Legislature, the following measure, relating to the Arizona health care cost containment system, is enacted to become valid as a law if approved by the voters and on proclamation of the Governor:

AN ACT

REPEALING SECTIONS 36‑2901.01 AND 36‑2901.02, Arizona Revised Statutes; AMENDING TITLE 36, CHAPTER 29, ARTICLE 1, Arizona Revised Statutes, BY ADDING A NEW SECTION 36‑2901.01; RELATING TO THE ARIZONA HEALTH CARE COST CONTAINMENT SYSTEM.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Repeal

Sections 36-2901.01 and 36-2901.02, Arizona Revised Statutes, are repealed.

Sec. 2.  Title 36, chapter 29, article 1, Arizona Revised Statutes, is amended by adding a new section 36-2901.01, to read:

For purposes of section 36-2901, "eligible person" includes any person who is defined as eligible based on an income level that does not exceed one hundred per cent of the federal poverty level guidelines as published annually by the United States department of health and human services, the resource limits defined by the director of the Arizona health care cost containment system administration and other eligibility requirements of federal law or the health care financing administration pursuant to section 1115 of the social security act. 2.  The Secretary of State shall submit this proposition to the voters at the next general election as provided by article IV, part 1, section 1, Constitution of Arizona.
