A CONCURRENT RESOLUTION

 

proposing an amendment to the constitution of arizona; amending article iv, part 1, constitution of arizona, by adding section 3; relating to initiative and referendum.

Be it resolved by the House of Representatives of the State of Arizona, the Senate concurring:

1.  Article IV, part 1, Constitution of Arizona, is proposed to be amended by adding section 3 as follows if approved by the voters and on proclamation of the Governor:

3.  Funding ballot measures; reauthorization requirement; special audit

SEction 3.  A.  If an initiative or referendum measure authorizes or requires the expenditure of state monies, that authorization or requirement is valid only for eight years.  At the end of this authorization period, a reauthorization measure shall be referred to a vote of the qualified electors at the next general election and shall be reauthorized for another eight years if approved by a majority of the votes cast on the measure and on proclamation of the Governor.

B.  This reauthorization requirement applies retroactively to all ballot measures from previous initiatives or referenda that authorize or require the expenditure of state monies.  These measures shall continue to be authorized until referred to a vote for reauthorization pursuant to this section.

C.  All ballot measures that are affected retroactively by this section and that were enacted into law eight years or more before the effective date of this section shall be referred to a vote of the qualified electors for reauthorization at the next general election following the effective date of this section.

D.  The auditor general shall conduct a special audit pursuant to law every five years to evaluate the costs of each measure that is voter protected pursuant to part 1, section 1 of this article.  The audit shall examine the costs of each measure from the date of the enactment to the present date.

E.  On or before August 15 of the audit year, the auditor general shall submit copies of the special audit to the governor, the president of the senate and the speaker of the house of representatives and provide a copy of this report to the secretary of state.

2.  The Secretary of State shall submit this proposition to the voters at the next general election as provided by article XXI, Constitution of Arizona.
