AN ACT

 

amending Title 15, chapter 2, article 1, Arizona Revised Statutes, by adding section 15-216; making an appropriation; relating to the state board of education.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 15, chapter 2, article 1, Arizona Revised Statutes, is amended by adding section 15-216, to read:

START_STATUTE15-216.  Technology-based reading intervention; educational technology provider; audit; report

A.  The state board of education shall submit a request for proposals to educational technology providers for the delivery of research-based technology-based reading intervention to assist pupils in kindergarten programs and grades one, two and three in this state who are classified as "falls far below" on the reading portion of the Arizona instrument to measure standards test or its successor test.  The state board shall establish the format of the applications, application procedures and selection criteria.  The state board shall select and award a contract to one educational technology provider to deliver research-based technology-based reading intervention pursuant to this section.  The state board shall distribute monies appropriated for this purpose to the selected provider.

B.  The educational technology provider shall deliver research-based technology-based reading intervention for pupils in kindergarten programs and grades one, two and three that:

1.  Is designed to accelerate language and literacy development by delivering individualized instruction that is designed to teach each pupil phonics, phonemic awareness, vocabulary, comprehension and fluency.  The software developed by the provider shall:

(a)  Be aligned to the common core standards.

(b)  Contain internal assessments, tracking and reports for teachers, administrators and parents.  The software program shall include additional resources to enable the teacher to more effectively meet the needs of each pupil.

(c)  Provide immediate feedback to pupils and provide automatic remediation when needed.

(d)  Include grade-level appropriate digital books with literature text and informational text.  Each pupil shall be able to practice reading on the computer by recording the pupil's readings and comparing the pupil's readings to the reading model.

(e)  Provide explicit instruction.  The program shall teach the core areas of reading comprehension, including intertextual comprehension so that pupils will be more prepared for the common core standards.

(f)  Explicitly teach pupils academic vocabulary that is related to core content areas and provide language development activities for those pupils requiring this assistance.

2.  Is easy for teachers to understand and implement without requiring supervision or extensive management and that allows teachers the option of:

(a)  Administering assessments.

(b)  Selecting print options.

(c)  Session time.

3.  Provides development strategies that include modeling, guided practice and comprehensible input.

4.  Provides curriculum that is based on common core state standards.

5.  Provides software that is current with frequent content and technology updates that occur at least once each year.

6.  Provides software that is user-friendly and that provide tutorials that introduce pupils to the computer and mouse and other hardware.

7.  Provides immediate feedback that is informative and that includes explanations in the primary language spoken in the pupil's home or reviews through simplified instruction or video.

9.  Provides individualized instruction that includes immediate remediation and delayed remediation.

10.  Provides on-site assistance and support for technical problems in less than twenty-four hours.

11.  Provides integrated and adaptive preassessment and postassessment of skills developed through the use of the software.  The assessment shall be used to modify instruction for that pupil.

12.  Provides printable real-time individual reports and classroom reports.

13.  Provides printouts and progress reports for parents in the primary language spoken in the pupil's home.

C.  The auditor general shall conduct annual financial audits of the research-based technology‑based reading intervention provided pursuant to this section.

D.  The state board of education shall submit an annual report on or before December 31 to the governor, the speaker of the house of representatives and the president of the senate regarding the research-based technology‑based reading intervention provided pursuant to this section.  The report shall include information on the number of school districts and charter schools that participate, the number of pupils who participate and the effectiveness of research-based technology‑based reading intervention.  The state board of education shall submit a copy of this report to the secretary of state. Sec. 2.  Appropriation; technology‑based reading intervention

The sum of $30,000,000 is appropriated from the state general fund in fiscal year 2013-2014 to the state board of education for the purpose of providing payment to the educational technology provider selected by the state board pursuant to section 15‑216, Arizona Revised Statutes, as added by this act.
