AN ACT

 

amending Title 4, chapter 2, article 3, Arizona Revised Statutes, by adding section 4-252; relating to liquor licenses.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 4, chapter 2, article 3, Arizona Revised Statutes, is amended by adding section 4-252, to read:

START_STATUTE4-252.  Licensees; possession, use or sale of synthetic cannabinoids; prohibition; license revocation; definition

A.  In addition to the unlawful acts prescribed in section 4‑244, paragraph 24, a licensee or an employee of a licensee shall not possess, use, sell or distribute synthetic cannabinoids on a licensed premise.  The department shall adopt rules pursuant to title 41, chapter 6 to carry out this section.

B.  In addition to any other criminal penalties and any other grounds prescribed in this title on which a license may be revoked, the director shall revoke a license issued pursuant to this title as prescribed in section 4-210 if the director determines that there has been a violation of subsection A of this section.

C.  For the purposes of this section, "synthetic cannabinoids" means any substance derived from synthetic chemicals or a combination of synthetic chemicals and botanical matter, that, when consumed, allegedly mimics the effects of cannabis, regardless of whether or not the synthetic cannabinoids contain any substances that meet the definition of "dangerous drug" defined in section 13‑3401.
