AN ACT
Amending title 36, chapter 28.1, Arizona Revised Statutes, by adding section 36-2820; relating to medical marijuana.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Pursuant to article IV, part 1, section 1, Constitution of Arizona, title 36, chapter 28.1, Arizona Revised Statutes, is amended by adding section 36-2820, to read:
36-2820. Advertising and labeling inconsistent with this chapter; prohibition; certification revocation
The department shall immediately revoke the registration certificate of a registered nonprofit medical marijuana dispensary that either:
1. Dispenses medical marijuana that is packaged in a way that misbrands or states that its use is for anything other than the medicinal purposes prescribed by this chapter. Any package of medical marijuana must be white and opaque and any labeling of medical marijuana must use only black text on a white background.
2. Advertises in a way that misbrands or states that it dispenses medical marijuana for a use other than the medicinal purposes prescribed by this chapter.
Sec. 2. Requirements for enactment; three-fourths vote
Pursuant to article IV, part 1, section 1, Constitution of Arizona, section 36-2820, Arizona Revised Statutes, as added by this act, is effective only on the affirmative vote of at least three-fourths of the members of each house of the legislature.
