SENATE AMENDMENTS TO H.B. 2232

Strike everything after the enacting clause and insert:

“Section 1.  Title 9, chapter 4, article 8, Arizona Revised Statutes, is amended by adding section 9-500.32, to read:

9-500.32.  Notices using the worldwide web; exception

A.  If publication of a notice in a newspaper is directed or authorized by law, notwithstanding any other law, the city or town responsible for publishing the notice may publish the notice in a newspaper or may provide notice on its website.  For a city or town without a website, the notice may be posted on the website operated by an association of cities and towns in this state.  For public notices posted on a city's or town's website, the city or town shall provide a link to the public notices in a prominent location on the city's or town's website's homepage.

B.  If the number of times the notice is to be published is not specified, the city, town or association shall publish the notice on the worldwide web for at least two consecutive weeks.

C.  If the city or town provides notice using the worldwide web, the city or town shall publish annually the website address where the city's or town's public notices may be found in a newspaper printed and published within the territorial limits of the city or town.  If no newspaper is printed and published within the limits of the city or town, the notice may be published in a newspaper printed and published in the county in which the city or town is located.

D.  This section does not apply to a city or town with a population of less than one hundred thousand persons.

Sec. 2.  Title 11, chapter 2, article 4, Arizona Revised Statutes, is amended by adding section 11-251.16, to read:

11-251.16.  Notices using the worldwide web

a.  If publication of a notice in a newspaper is directed or authorized by law, notwithstanding any other law, the county responsible for publishing the notice may publish the notice in a newspaper or may provide notice on its website.  For a county without a website, the notice may be posted on the website operated by an association of counties in this state.  For public notices posted on a county's website or, the county shall provide a link to the public notices in a prominent location on the county's website's homepage.

B.  If the number of times the notice is to be published is not specified, the county or association shall publish the notice on the worldwide web for at least two consecutive weeks.

C.  If the county provides notice using the worldwide web, the county publish annually the website address where the county's public notices may be found in a newspaper printed and published within the county.  If no newspaper is printed and published within the county, the notice may be published in a newspaper of general circulation in the county that is printed in an adjoining county.
