AN ACT

 

Amending title 41, chapter 23, Arizona Revised Statutes, by adding article 14; amending section 41‑4602, Arizona Revised Statutes; relating to governmental reporting of information and the procurement code.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 41, chapter 23, Arizona Revised Statutes, is amended by adding article 14, to read:

ARTICLE 14.  APPEAL OF SOLICITATIONS AND CONTRACT AWARDS

START_STATUTE41-2681.  Appeal of solicitations and contract awards; evidence; new issues

A.  At a hearing held pursuant to chapter 6, article 10 of this title, the administrative law judge may allow the protesting party to present evidence relevant to the issues raised in the appeal from the decision of the procurement officer and evidence relevant to any issues that are raised by the procurement officer or any party who intervenes in the hearing.

B.  At a hearing held pursuant to chapter 6, article 10 of this title, and on reasonable advance notice to all parties to that hearing, the administrative law judge may allow the protesting party to raise one or more new issues that the protesting party did not raise in the protest or appeal to the director if all the following apply:

1.  The protesting party demonstrates to the satisfaction of the administrative law judge that the protesting party could not have reasonably discovered each new issue in time to add the issue to the protest.

2.  The new issue is material in the sense that if the administrative law judge agrees with the position OF the protesting party concerning the new issue, the administrative law judge would enter a decision in favor of the protesting party.

3.  The protesting party has exhausted all applicable remedies pursuant to section 41-2611, including all provisions that pertain to the extension of the time for filing protests and allowing late protests on a showing of good cause.

4.  The protesting party demonstrates to the satisfaction of the administrative law judge that the protesting party has acted with reasonable speed and diligence in discovering the new issue and has not unreasonably delayed in seeking relief under this section.END_STATUTE

Sec. 2.  Section 41-4602, Arizona Revised Statutes, is amended to read:

START_STATUTE41-4602.  Comprehensive internet web portal of local governments

The department of administration shall establish an internet web portal that provides a list of all local governments with jurisdiction over any address entered by a user.  Each listing shall be linked to an agency website maintained by each local government that shall primarily contain the following information:

1.  The name of the local government's governing board with official contact information for each board member, including a phone number for direct contact by constituents.

2.  The name and contact information for the administrative head of the local government.

3.  Information for how the governing board and administrative head of the local government are selected, including dates of the next election, if any, durations of terms and names and contact information of appointing authorities, as applicable.

4.  Information on taxes or fees controlled by the local government, including the total taxes per capita of the local government for the population within its jurisdiction along with a statewide average of all similar local governments as calculated by the department, and proposed changes in the taxes or fees.

5.  Information on special elections, which shall be posted at least ninety days in advance of the election date.

6.  A link to the official internet website required by section 41-725.

7.  The total value of all outstanding debt obligations, including the actuarial value of unfunded pension liabilities and the equivalent amount on a per capita basis for the population within the local government's jurisdiction. END_STATUTE
