A CONCURRENT RESOLUTION

 

enacting and ordering the submission to the people of a measure relating to early childhood development and health programs.

Be it resolved by the House of Representatives of the State of Arizona, the Senate concurring:

1.  Under the power of the referendum, as vested in the Legislature, the following measure, relating to early childhood development and health programs, is enacted to become valid as a law if approved by the voters and on proclamation of the Governor:

AN ACT

amending SECTION 8‑1185, ARIZONA REVISED STATUTES; RELATING TO early childhood development and health programs.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Section 8-1185, Arizona Revised Statutes, is amended to read:

START_STATUTE8-1185.  Allocation of funds

A.  aT LEAST twenty‑five percent of the monies EXPENDED in each fiscal year FROM the program account of the early childhood development and health fund established by section 8‑1181 must be used to fund programs and services for children in the child protective services program established by chapter 10 of this title AND THEIR FAMILIES, INCLUDING FOSTER FAMILIES CARING FOR THE CHILDREN.  The board shall coordinate with the director of the department of economic security to determine the appropriate allocation and expenditure of the monies for the following Programs and services:

1.  Child neglect and abuse prevention.

2.  Family support and other in-home services.

3.  Child care assistance.

4.  Mental health.

5.  Parental education and coaching.

6.  sUBSTANCE ABUSE TREATMENT AND COUNSELING.

7.  Ongoing services FOR A REASONABLE PERIOD OF TIME for families after a child who has been removed from the home is returned to the home.

A.  B.  Of the monies expended in a fiscal year from the program account of the early childhood development and health fund established by section 8-1181, no more than ten percent may be used to fund statewide grants or programs undertaken directly by the board pursuant to section 8-1192.

B.  C.  Of the monies in the program account used to fund approved regional plans in a fiscal year, thirty-five percent must be provided to fund regional plans based on the population of children aged five and younger in the region.  Forty percent must be provided to fund regional plans based on the population of children aged five and younger in the region whose family income does not exceed one hundred percent of the federal poverty guidelines as defined by section 46-801(9).  The remaining twenty-five percent may be used to fund regional programs without consideration of regional population.  For the purpose of this section, the board shall estimate population based on available information and using a method chosen at its discretion. 2.  The Secretary of State shall submit this proposition to the voters at the next general election as provided by article IV, part 1, section 1, Constitution of Arizona.
