AN ACT
amending title 3, chapter 2, article 5, Arizona Revised Statutes, by adding section 3-351.01; providing for the delayed repeal of section 3-351.01, Arizona Revised Statutes, as added by this act; relating to the Arizona department of agriculture.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Title 3, chapter 2, article 5, Arizona Revised Statutes, is amended by adding section 3-351.01, to read:
3-351.01. Registration fee; increase or decrease; exemption
A. Notwithstanding any other law, the director, with the assistance of the department of agriculture advisory council, may increase or decrease the registration fee established by section 3‑351 until June 30, 2016.
B. Any additional revenue generated by increasing the fee as provided in subsection A of this section must be deposited in the pesticide trust fund established by section 3‑350. The fee may not be reduced pursuant to subsection A of this section below one hundred dollars.
C. The department is exempt from the rulemaking requirements of title 41, chapter 6 for the purpose of increasing or decreasing fees pursuant to this section until July 1, 2016.
Sec. 2. Delayed repeal
Section 3‑351.01, Arizona Revised Statutes, as added by this act, is repealed from and after June 30, 2016.
