AN ACT
amending title 41, chapter 15, article 1, Arizona Revised Statutes, by adding section 41‑2053; relating to public transportation safety zones.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Title 41, chapter 15, article 1, Arizona Revised Statutes, is amended by adding section 41-2053, to read:
41-2053. Transportation safety zones; passenger convenience areas; definitions
A. Notwithstanding section 41‑2052, a city or town may adopt a resolution or ordinance to establish passenger convenience areas and taxi and livery vehicle lanes within a transportation safety zone.
B. The governing body of a city or town, by resolution or ordinance, may establish a transportation safety zone, if the governing body finds that a transportation safety zone is necessary to preserve the public health, safety and general welfare. A resolution or ordinance that is adopted pursuant to this subsection must include a map that establishes the boundaries of the zone and traffic safety data used to justify the establishment of the zone. Each transportation safety zone may not be greater than three square miles, and a city or town may not establish more than two transportation safety zones within its corporate boundaries.
C. On establishment of a transportation safety zone, the city or town may place and maintain permanently affixed signs located in a visible manner at the public vehicular access points leading into the zone for the purpose of delineating the boundaries of the zone.
D. Except as necessary to protect the public safety, a city or town may not prescribe the order in which a taxi may load or unload passengers in a passenger convenience area.
E. For the purposes of this section:
1. "Passenger cart" means any motorized vehicle, except a bus, that is used to transport passengers on a public roadway in exchange for any form of payment or gratuity and that is not licensed as a livery vehicle, taxi or limousine pursuant to this chapter.
2. "Passenger convenience area" means an area that is designated by a city or town for the loading and unloading of passengers by passenger carts, livery vehicles, taxis or limousines.
