AN ACT
Amending Title 9, chapter 7, article 1, Arizona Revised Statutes, by adding section 9-808; Amending Title 11, chapter 6, article 5, Arizona Revised Statutes, by adding section 11-867; relating to city and county codes.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Title 9, chapter 7, article 1, Arizona Revised Statutes, is amended by adding section 9-808, to read:
9-808. Mandated energy efficiency or conservation prohibited; exception; definition
A. A city or town may not adopt as mandatory any, or part of any, building code, ordinance, stipulation or other legal requirement that is related to energy efficiency, energy conservation or green construction in new construction.
B. A city or town may not deny any license or building permit or impose any fine, penalty or other requirement on any person or entity for failure to comply with any, or part of any, building code, ordinance, stipulation or other legal requirement that is related to energy efficiency, energy conservation or green construction in new construction.
C. This section does not apply to any, or part of any, building code, ordinance, stipulation or other legal requirement relating to energy efficiency, energy conservation or green construction in new construction that was adopted and effective before the effective date of this section or to any, or part of any, ordinance that solely regulates outdoor lights.
D. For the purposes of this section, "building code" includes the international energy conservation code, international green construction code and the energy conservation chapters of the international building code and international residential code, however denominated.
Sec. 2. Title 11, chapter 6, article 5, Arizona Revised Statutes, is amended by adding section 11-867, to read:

B.
