AN ACT

 

amending title 42, chapter 13, Arizona Revised Statutes, by adding article 11; relating to conservation land.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 42, chapter 13, Arizona Revised Statutes, is amended by adding article 11, to read:

ARTICLE 11.  CONSERVATION LAND

START_STATUTE42-13501.  Identifying land used for conservation purposes; definition

A.  The county assessor shall identify land used for conservation purposes under this article.

B.  The department shall create a new identifiable property use code for conservation land under this article.

C.  Land identified under this article must be used for conservation purposes and be any of the following:

1.  Owned by a governmental body empowered to hold an interest in real property under the laws of this state or the United States.

2.  Owned by a charitable corporation or trustee of a charitable trust, the purposes or powers of which include retaining or protecting the natural, scenic or open space values of real property, ensuring the availability of real property for agricultural, forest, recreational or open space use, protecting natural resources, maintaining or enhancing air or water quality or preserving the historical, architectural, archaeological or cultural aspects of real property.

3.  Private property that has a conservation easement or other conservation overlay use or purpose.

D.  For the purposes of this section, "conservation purposes" means any of the following activities:

1.  Preserving land areas for outdoor recreation by, or the education of, the general public.

2.  Protecting a relatively natural habitat of fish, wildlife or plants, a wilderness or riparian area or a similar ecosystem.

3.  Preserving or protecting open space. END_STATUTE
