HOUSE OF REPRESENTATIVES AMENDMENTS TO H.B. 2301

Strike everything after the enacting clause and insert:

"Section 1.  Title 16, chapter 3, Arizona Revised Statutes, is amended by adding article 5.1, to read:

ARTICLE 5.1.  NOMINATION BY POLITICAL PARTY CAUCUS

START_STATUTE16-349.  Partisan political offices; nomination; party caucus

Notwithstanding any other law:

1.  A political party may nominate candidates for all state, county and city or town partisan political offices by way of a political party caucus.

2.  A political party shall ESTABLISH its own PROCEDURES for nominating a candidate at that political party's caucus and each party's nominee from that party's political party caucus shall appear on the general election ballot as the candidate for that party.

3.  Candidates for nonpartisan political offices shall be determined as otherwise PROVIDED by law. END_STATUTE

Sec. 2.  Conditional enactment

Title 16, chapter 3, article 5.1, Arizona Revised Statutes, as added by this act, does not become effective unless the Constitution of Arizona is amended by vote of the people at the next general election to provide for the nomination of candidates for partisan political offices by political party caucuses.

Sec. 3.  Conforming legislation

If the condition prescribed by section 2 of this act is met, the legislative council staff shall prepare proposed legislation conforming the Arizona Revised Statutes to the provisions of this act for consideration in the fifty-second legislature, first regular session."
