AN ACT

 

amending title 13, chapter 29, Arizona Revised Statutes, by adding section 13‑2914; relating to dog tethering.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 13, chapter 29, Arizona Revised Statutes, is amended by adding section 13-2914, to read:

START_STATUTE13-2914.  Unlawful dog tethering; classification

A.  It is unlawful to permanently attach a dog to a stationary object for more than twenty-four continuous hours and in a manner that does not allow the dog to eat and sleep in an area that is apart from where the dog urinates and defecates unless The person who owns, possesses, controls or otherwise has charge of the dog is physically present with the dog.

B.  This section does not apply to a dog that is used in activities permitted by or pursuant to title 3 or 17 or in activities regulated by the Arizona department of agriculture or the Arizona game and fish department.

C.  A person who violates this section is guilty of a class 3 misdemeanor.END_STATUTE
