AN ACT
amending section 13‑2810, Arizona Revised Statutes; relating to interference with judicial proceedings.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Section 13-2810, Arizona Revised Statutes, is amended to read:
13-2810. Interfering with judicial proceedings; global position system or electronic monitoring; fee; classification
A. A person commits interfering with judicial proceedings if such person knowingly:
1. Engages in disorderly, disrespectful or insolent behavior during the session of a court which directly tends to interrupt its proceedings or impairs the respect due to its authority; or
2. Disobeys or resists the lawful order, process or other mandate of a court; or
3. Refuses to be sworn or affirmed as a witness in any court proceeding; or
4. Publishes a false or grossly inaccurate report of a court proceeding; or
5. Refuses to serve as a juror unless exempted by law; or
6. Fails inexcusably to attend a trial at which he the person has been chosen to serve as a juror.
B. If a person is convicted of a violation of subsection A, paragraph 2 of this section involving a violation of an order of protection pursuant to section 13-3602, an injunction against harassment pursuant to section 12‑1809 or an injunction against workplace harassment pursuant to section 12‑1810, the court may require global position system or electronic monitoring for all or part of the time that the order of protection or injunction is in effect. The court may impose a fee on the defendant to offset the cost of the monitoring device that is required by this subsection.
B. C. Interfering with judicial proceedings is a class 1 misdemeanor, except that a second or subsequent violation of subsection A, paragraph 2 of this section involving a violation of an order of protection pursuant to section 13-3602, an injunction against harassment pursuant to section 12-1809 or an injunction against workplace harassment pursuant to section 12-1810 is a class 6 felony.
