AN ACT

 

amending sections 16-250, 26-152, 41‑533, 41‑608.03, 41-824 and 43-409, Arizona Revised Statutes; relating to government budget reconciliation.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Section 16-250, Arizona Revised Statutes, is amended to read:

START_STATUTE16-250.  Expenses of election

A.  The secretary of state in consultation with the county recorders and the county officers in charge of elections shall include in the budget request for the department of state sufficient monies from the state general fund to conduct the presidential preference election prescribed by this article.

B.  Reimbursement of charges incurred by the counties for the presidential preference election shall be made at one hundred per cent of the costs incurred in the amount of one dollar twenty‑five cents for each active registered voter in the county on January 1 of the year of the presidential preference election as evidenced by a proper claim submitted to the secretary of state.  If the secretary of state determines that reimbursement at the rate prescribed by this subsection would jeopardize the ability of a county to comply with federal and state laws and regulations, the secretary of state may release the county from that rate of reimbursement. Sec. 2.  Section 26-152, Arizona Revised Statutes, is amended to read:

START_STATUTE26-152.  National guard fund; camp Navajo fund

A.  The national guard fund is established consisting of monies appropriated to the national guard.

B.  The fund may be drawn upon on by the adjutant general for any purpose commensurate with the purpose and mission of the national guard.

C.  The amount of the national guard fund appropriated for capital outlay or improvements shall be exempt from the provisions of section 35‑190 relating to lapsing appropriations.

D.  All proceeds from the rental or use of armories received by the general staff pursuant to the authority of section 26‑115, subsection E shall be deposited, pursuant to sections 35‑146 and 35‑147, in a separate account in the national guard fund, and the monies are continuously appropriated to the department for the maintenance of armories.  Monies in the account are exempt from the provisions of section 35‑190 relating to lapsing of appropriations, except that any monies remaining in the account for one hundred eighty days after the end of the fiscal year in which they were received revert to the state general fund.

E.  A camp Navajo fund is established for the operation, maintenance, capital improvements and personal services necessary for the national guard to operate a regional training site and storage facility at Bellemont facilities.  The fund consists of monies received from storage of commodities and services provided as approved by the adjutant general.  The adjutant general shall administer the fund.  On notice from the adjutant general, the state treasurer shall invest and divest monies in the fund as provided by section 35‑313, and monies earned from investment shall be credited to the fund.  Monies in the fund are continuously appropriated to the national guard and are exempt from the provisions of section 35‑190 relating to lapsing of appropriations.END_STATUTE

Sec. 3.  Section 41-533, Arizona Revised Statutes, is amended to read:

START_STATUTE41-533.  Arizona commission of African-American affairs fund

A.  The Arizona commission of African-American affairs fund is established.  The monies in the Arizona commission of African-American affairs fund are continuously appropriated to the Arizona commission of African-American affairs.  The fund consists of monies received pursuant to section 41‑532.  The state treasurer shall invest and divest all monies in the Arizona commission on of African-American affairs fund as provided by section 35-313, and monies earned from investment shall be credited to the fund.  The state treasurer Arizona commission of African-American affairs shall administer the fund.  The monies in the fund are exempt from the provisions of section 35‑190 relating to lapsing of appropriations.

B.  The state treasurer shall pay the costs and expenses authorized by this article from the monies available in the Arizona commission of African‑American affairs fund on certification to the state treasurer by the chairperson of the Arizona commission of African-American affairs that the amount requested is owed for a valid purpose. Sec. 4.  Section 41-608.03, Arizona Revised Statutes, is amended to read:

START_STATUTE41-608.03.  Arizona state veterans' cemetery trust fund; donations; purpose

A.  The southern Arizona state veterans' cemetery trust fund is established consisting of monies, grants, gifts and contributions donated to the fund from any public or private source.  The director shall hold the monies in trust to manage and maintain the southern Arizona veterans' cemetery, the Arizona veterans' memorial cemetery at Camp Navajo and the Arizona veterans' memorial cemetery at Marana.

B.  The director shall deposit the donations to the fund, pursuant to sections 35‑146 and 35‑147, in the fund.

C.  Monies in the fund are:

1.  Subject to state auditing procedures.

2.  Continuously appropriated.

3.  Exempt from the provisions of section 35‑190 relating to lapsing of appropriations.

D.  On notice from the director, the state treasurer shall invest and divest monies in the fund as provided by section 35‑313.  The state treasurer shall credit to the fund monies earned from the investments. END_STATUTE

Sec. 5.  Section 41-824, Arizona Revised Statutes, is amended to read:

START_STATUTE41-824.  Journal of Arizona history

A.  The Arizona historical society shall publish a magazine, to be known as "Journal of Arizona History", at least four times per year.

B.  A journal of Arizona history magazine fund is established consisting of monies appropriated by the legislature and all monies received from subscriptions.  These monies shall be expended in conformity with the laws governing state financial operations.  Balances remaining in the fund at the end of the fiscal year shall not revert to the general fund.

C.  On notice from the director, the state treasurer shall invest and divest monies in the fund as provided by section 35‑313, and monies earned from investment shall be credited to the fund. END_STATUTE

Sec. 6.  Section 43-409, Arizona Revised Statutes, is amended to read:

START_STATUTE43-409.  Job creation withholdings clearing account

A.  The job creation withholdings clearing account is established consisting of the sum of thirty‑one twenty-six million five hundred thousand dollars of withholding tax revenues in each fiscal year 2015-2016 and twenty‑one million five hundred thousand dollars for each fiscal year after 2015-2016.

B.  On the twentieth day of each month the state treasurer shall credit the following amounts from the clearing account:

1.  To the Arizona commerce authority fund established by section 41‑1506, one-twelfth of the annual sum of ten million dollars in each fiscal year.

2.  To the Arizona competes fund established by section 41‑1545.01, one‑twelfth of the annual sum of twenty‑one sixteen million five hundred thousand dollars in each fiscal year 2015-2016 and eleven million five hundred thousand dollars for each fiscal year after 2015-2016.
