AN ACT

 

amending section 15‑802.01, Arizona Revised Statutes; relating to interscholastic activities.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Section 15-802.01, Arizona Revised Statutes, is amended to read:

START_STATUTE15-802.01.  Homeschooled children and online charter school pupils; eligibility to participate in interscholastic activities; definition

A.  Notwithstanding any other law, a child who resides within the attendance area of a public school and who is homeschooled or who is enrolled in an online charter school shall be allowed to try out for interscholastic activities on behalf of the public school in the same manner as a pupil who is enrolled in that public school. Registration, age eligibility requirements, fees, insurance, transportation, physical condition, qualifications, responsibilities, event schedules, standards of behavior and performance policies for homeschooled and online charter school students shall be consistent with those policies established for students enrolled in that public school.  The individual providing the primary instruction of a child who is homeschooled or the principal or chief administrator of the online charter school in which the pupil is enrolled shall submit written verification that provides:

1.  Whether the student is receiving a passing grade in each course or subject being taught.

2.  Whether the student is maintaining satisfactory progress towards advancement or promotion.

B.  A child who is homeschooled and who was previously enrolled in a public, private or charter school shall be ineligible to participate in interscholastic activities for the remainder of the school year during which the child was enrolled in a school.

C.  A pupil who is enrolled in an online charter school and who was previously enrolled in a private school or a public school that was part of a school district shall be ineligible to participate in interscholastic activities for the remainder of the school year during which the pupil was enrolled in a private school or a public school that was part of a school district.

C.  D.  A school district shall not contract with any private entity that supervises interscholastic activities if the private entity prohibits the participation of homeschooled children or pupils who are enrolled in a charter school in interscholastic activities at public, private or charter schools.

E.  An online charter school pupil may be charged a fee to participate in interscholastic activities if the public school charges the same fee to students who are enrolled in the public school.

F.  For the purposes of this section, "online charter school" means a charter school that provides online instruction to pupils in grades seven, eight, nine, ten, eleven or twelve pursuant to section 15‑808. END_STATUTE
