AN ACT

 

amending title 41, chapter 6, article 7.2, Arizona Revised Statutes, by adding section 41-1080.01; relating to licensing eligibility.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 41, chapter 6, article 7.2, Arizona Revised Statutes, is amended by adding section 41-1080.01, to read:

START_STATUTE41-1080.01.  Home-based business; licensing moratorium during state of emergency or state of war emergency; unemployment rate; definitions

A.  If the governor declares a state of emergency or a state of war emergency in this state or if the statewide unemployment rate exceeds ten percent according to the United states department of labor, bureau of labor statistics, an agency may not require a home-based business in this state to have a valid license during the state of emergency or the state of war emergency or while the statewide unemployment rate exceeds ten percent.  After the governor declares that the state of emergency or the state of war emergency has ended or the statewide unemployment rate no longer exceeds ten percent, an agency may require a home-based business to have a valid license as prescribed by law before the home-based business engages in any further conduct of business.

B.  This section does not exempt any home-based business from any other applicable law and ordinance.

C.  For the purposes of this section:

1.  "Agency" means any agency, department, board or commission of this state or of any political subdivision of this state that issues a license for the purpose of operating a business in this state or to an individual who provides a service to any person.  Agency does not include the Arizona corporation commission.

2.  "Home-based business" means any business for the limited manufacture, provision or sale of goods or services that is owned and operated by the owner or tenant of the residential property.

3.  "License" means any permit, certificate, approval, registration, charter or similar form of authorization that is required by law and that is issued by any agency for the purpose of operating a business in this state or to an individual who provides a service to any person and the license is required to perform that service.

4.  "State of emergency" has the same meaning as prescribed in section 26-301.

5.  "State of war emergency" has the same meaning as prescribed in section 26-301. END_STATUTE
